Terms and Conditions

Welcome to Property Pix. These Terms and Conditions explain how we operate and what you can expect when booking our photography and media services. By using our website or working with us, you agree to the terms below — they help keep everything clear and fair for everyone.

Effective Date: 9 October 2025

1. Services

1.1. Property Pix provides property photography and media services, including but not limited to interior and exterior photography, drone photography, virtual tours, floor plans, and video production.
1.2. The scope of services will be detailed in the quotation, service agreement, or invoice issued to the client.
1.3. Drone operations are subject to weather conditions and Irish Aviation Authority (IAA) regulations. Flights may be postponed or cancelled if conditions are unsafe or non-compliant.

2. Booking and Payment

2.1. Bookings can be made via our website, email, or phone.
2.2. An invoice will be issued upon completion of the work and must be paid within 30 days of the invoice date.
2.3. A deposit may be required for new clients or larger bookings.
2.4. Payments can be made via Stripe (linked to invoice), credit card, or bank transfer.
2.5. Late payments beyond 30 days may incur interest at a rate of 2% per month and may result in suspension of future services until payment is received.

3. Cancellation and Rescheduling

3.1. Cancellations made more than 24 hours before the scheduled session will incur no additional charges beyond any deposit.
3.2. Cancellations made within 24 hours of the scheduled session will incur a €50 charge.
3.3. Rescheduling requests must be made at least 24 hours in advance and are subject to availability.
3.4. Property Pix reserves the right to postpone or reschedule sessions in cases of poor weather, unsafe drone conditions, illness, or other circumstances beyond our control.
3.5. If the photographer arrives and access is not available or the property is not ready to be photographed, a €50 call-out fee may apply.

4. Image Delivery and Usage

4.1. Edited images will be delivered within 48 hours after the photography session, unless otherwise agreed.
4.2. Media will be delivered digitally via a secure online gallery or download link.
4.3. The client is granted a non-exclusive, non-transferable license to use the images solely for marketing and promotion of the specific property photographed.
4.4. Images may not be resold, transferred, or reused for other properties or future marketing without written consent from Property Pix.
4.5. Property Pix retains full copyright ownership of all media and reserves the right to use selected material for portfolio, social media, or promotional purposes.
4.6. Matterport 3D tours will be removed once a property is sold and/or after 12 months of hosting, whichever comes first. Tours may be re-hosted for €50 + VAT per annum.
4.7. Property Pix does not guarantee storage of files beyond 6 months after delivery. Clients are responsible for downloading and backing up their media.

5. Client Responsibilities

5.1. The client must ensure the property is ready for photography at the scheduled time.
5.2. This includes cleaning, decluttering, staging, and ensuring access to all relevant areas.
5.3. Pets and occupants should be kept out of view during photography sessions.
5.4. Property Pix photographers will capture the property as presented. Additional editing or reshoots requested due to staging or cleanliness issues will incur additional fees.

6. Liability

6.1. Property Pix will exercise all reasonable care while performing its services.
6.2. Property Pix is not liable for any damage to property or loss of personal items during the photography session.
6.3. In the event of equipment failure, extreme weather, or other unforeseen circumstances, Property Pix will reschedule the session at no additional cost.
6.4. Property Pix’s total liability for any claim, whether in contract, tort, or otherwise, shall not exceed the total amount paid by the client for the specific service in question.

7. Refund Policy

7.1. Refunds are not provided for completed services unless there is a demonstrable failure to deliver the agreed-upon deliverables.
7.2. If a refund is approved, it will be processed within 10 business days.
7.3. Due to the artistic nature of photography, dissatisfaction based on subjective preferences such as style, composition, or creative direction does not constitute a failure to deliver the service

8. Dispute Resolution

8.1. These Terms and Conditions are governed by the laws of the Republic of Ireland.
8.2. Both parties agree to attempt mediation in good faith before initiating any legal proceedings.
8.3. If mediation fails, disputes shall be subject to the exclusive jurisdiction of the Irish courts.

9. Amendments

9.1. Property Pix reserves the right to amend these Terms and Conditions at any time.
9.2. Clients will be notified of significant changes before their next booking.
9.3. Continued use of Property Pix services after notification of changes constitutes acceptance of the updated Terms and Conditions.

10. Data Protection

10.1. Property Pix complies with the General Data Protection Regulation (GDPR).
10.2. Client data, including contact details and property media, is used solely for the purpose of delivering services and managing accounts.
10.3. We do not share personal information with third parties except where required for operational delivery or by law.
